Course context for academic year 2026-27
La asignatura Procedimiento Laboral I tiene como finalidad esencial ofrecer al alumno, tras una explicación teórica de las nociones básicas del Derecho Procesal, el análisis exhaustivo tanto teórico como práctico del funcionamiento del Orden Jurisdiccional Social en sus aspectos organizativos y procesales.
Es una materia esencial para el Graduado Social, pues, como asesores laborales, los Graduados Sociales y Diplomados en Relaciones Laborales, necesitan obtener un conocimiento amplio del Proceso laboral, para poder desarrollar su actividad de asesoramiento en Derecho del Trabajo y de la Seguridad Social a trabajadores y empresarios ante los múltiples conflictos individuales o colectivos que pueden someter a su criterio profesional y para cumplir el objetivo principal, la última ratio del Proceso laboral, la Paz Social. En este sentido, es absolutamente necesario comprometerse desde el ámbito universitario para dar una visión práctica del Proceso Laboral, y acercar al alumno a situaciones prácticas con las que se van a enfrentar en su futuro profesional.
Es aconsejable, por lo demás, que el alumno tenga, para asumir el estudio de esta asignatura, unos conocimientos básicos previos de las distintas Instituciones que conforman el Derecho del Trabajo. Es decir, deberá saber cuáles son esas Instituciones, su funcionamiento y las distintas normas que las regulan. Asimismo, deberá ser capaz de manejar tanto la Legislación procesal, principalmente la Ley de Procedimiento laboral y la Ley de Enjuiciamiento Civil, como la jurisprudencia e interpretación que los Tribunales Laborales dan a los artículos y preceptos que serán objeto de estudio
