Course context for academic year 2026-27
La asignatura Derecho Sindical II está orientada a completar la formación jurídico-laboral de los estudiantes sobre las relaciones colectivas en la empresa y en la Administración Pública. Su finalidad esencial es ofrecer al alumno el análisis exhaustivo, tanto teórico como práctico, de la ordenación jurídica de la negociación colectiva como proceso de interrelación entre los diferentes actores que participan en el ámbito laboral, y del convenio colectivo como resultado; así como de la acción institucional de los sujetos colectivos a través de su participación en órganos de la Administración Pública y de la concertación social. Completa el programa el estudio del conflicto colectivo como manifestación del derecho de los sujetos colectivos a reivindicar sus condiciones laborales, con especial atención a la huelga como derecho fundamental y al cierre patronal como medida empresarial de respuesta.
Es evidente que el conocimiento de todas estas materias resulta esencial para la formación del futuro graduado, pues le va a permitir comprender de mejor modo la organización, gestión y composición de las relaciones de trabajo en la empresa y actuar, al tiempo, con mayor diligencia y eficacia en los diferentes campos para los que capacita esta titulación: por un lado, el de asesoramiento jurídico-laboral (graduado social) y, por otro, el de la dirección y gestión de recursos humanos.
Es aconsejable, por lo demás, que el alumno tenga, para asumir el estudio de esta asignatura, unos conocimientos básicos previos del derecho fundamental de la libertad sindical, de su contenido, efectos y consecuencias, así como de la organización y representación de los trabajadores en la empresa. Contenidos que se estudian en la asignatura Derecho Sindical I.
