OBJECTIVES


  • To comply with the training requirements established by Act 34/2006 of 30 October, in relation to Advocacy professionals
  • To provide quality vocational training of future lawyers and practising lawyers in that the relevant staff from the Administration of Justice Department will guarantee the exercise of fundamental rights to effective judicial tutelage.
  • To facilitate integration of post-graduates into the labour force by providing them with knowledge about the legal framework and present day legal practice context.
  • To raise awareness among students as regards the democratic values and the code of conduct and ethics related to this profession.
  • To prepare students for the accreditation of their professional training.

GENERAL COURSE PROGRAMME 

The Master’s programme includes key issues required for the practice of advocacy, such as the legal bar association framework, and practice in techniques and tools for the profession of advocacy. The remaining matters focus on topics that could be divided into the four judicial areas, dealing with both extrajudicial and judicial aspects. The programme aims to combine general training in the competences, skills and attitudes required for the practice of advocacy with specific areas of expertise. The work experience combines both aspects, i.e., the application of what has been learned to the actual practice of advocacy. The Master’s Degree Final Project aims to consolidate the student's educational experience through the creation of a file or a report concerning a specific case that was dealt with over the course of their studies and work experience.

ENTRY REQUIREMENTS

According to the Regulations of the University of Alicante, the following requirements must be complied to have access to official taught Master’s degrees:

  1. To be in possession of a SPANISH OFFICIAL GRADUATE DEGREE CERTIFICATE or other issued by an institution of higher education  within the EHEA (European Higher Education) that enables the holder to have access  to Master’s degrees in the issuing.
  2. To be in possession of an officially approved  FOREIGN HIGHER EDUCATION DEGREE CERTIFICATE that had been recognised as equal to the degree that allows access to the requested studies.
  3. To be in possession of a UNIVERSITY DEGREE CERTIFICATE obtained in a University or Higher Education Institution of COUNTRIES OUTSIDE THE EHEA, without the prior approval of their studies. In this case, the following should be considered:
  • Non- recognised degree certificates shall require a technical report showing an equivalence statement issued by the University of Alicante (ContinUA – Continuing Education Centre), for which the corresponding fee should be paid.
  • Access through this way does under no circumstances imply prior official approval of the holder’s degree certificate, nor its recognition for purposes other than studying a master's degree.

 

ADMISSION AND ASSESSMENT CRITERIA

Given that the Master of Laws is offered to meet the educational and practical professional requirements established by the regulations which govern access to the legal profession, “Ley de Acceso”, the admission requirement is set out in Article 2.1.a) of the Royal Decree 775/2011 of 3 June, (whereby Regulation of Act 34/2006 of 30 October is approved regarding access to the professions of Advocate and Court Solicitor), that is, “Applicants holding degrees in Law, Law graduates or other equivalent university degrees which meet the requirements of Article 3 of this regulation”.

According to Article 3 of Royal Decree 775/2011 of 3 June, which approves the Regulation of Act 34/2006, of 30 October, on access to the professions of Advocate and Court Solicitor, the aforementioned requirements are as follows:

The undergraduate degrees referred to in the Section 2, clause a) must accredit the acquisition of the following legal competences:

a) Knowledge and understanding of the elements, structure, resources, interpretation and application of law, and ability to interpret the sources and fundamental legal concepts of jurisprudence and different law systems.

b) Knowledge and understanding of the mechanisms and procedures for resolving legal disputes, and the legal position of individuals in their relations with both government and the authorities.

c) Knowledge of how to apply the criteria of priority of sources to determine the rules applicable in each case, and especially that of compliance with rules, and constitutional principles and values. 

d) Interpretation of legal texts from an interdisciplinary perspective by using legal principles and social, ethical, deontological values and principles as tools for analysis.

e) Delivering of convincing legal arguments on a theoretical question concerning various legal matters.

f) Solving case studies according to existing Law, which involves the prior preparation of material, identification of problematic areas, the selection and interpretation of the applicable law and a reasoned exposition of the subsumption.

g) Management of legal language and terminology of different branches of the law with skill and precision to include the drafting of legal documents in an orderly and understandable manner, as well as the oral and written communication of ideas, arguments and legal reasoning using the appropriate register in each context.

h) Using information and communication technologies for searching and gathering legal information (from legislation databases, jurisprudence, bibliographies, etc.) and as a tool for work and communication.

No additional requirements are established. However, if the number of applications exceeds the number of available places, admission will be according to the average mark of the Law degree. In this case, the Committee for the Coordination of the Master’s Degree may prioritise admission of applicants who are required to study the Master’s Degree over those who are or may already be chartered legal professionals and do not need a professional qualification as court solicitor under the existing regulations which govern access to the legal profession.

Additionally the following skills are recommended: good oral and written expression, inductive and deductive reasoning, ability to observe, identify and initiate problem solving and organizational capability.
