INTRODUCTION
The University of Alicante (hereinafter, 'UA') makes available to the university community the application 'Classified Ads' (hereinafter, 'the application') in order to facilitate the provision of advertising and exchange services, products and communications of interest to users of the university community. Non-members of the university community will be able to make use of the application without losing sight of the primary objective stated in the previous sentence.
The use of the University of Alicante application 'Classified Ads' implies acceptance of all our Terms of Use and our Privacy Policy.
COMMITMENTS
The user is committed to:
- Not encouraging others to act unlawfully.
- Not spreading any action for defamation, libel, insults, content or propaganda that is racist, xenophobic, statements that supports terrorism or violate human rights.
- Not expressing falsehoods or misleading the user.
- Not impersonating other users by using their access codes to the different services or contents of the application.
- Not using false e-mails to advertise announcements.
- Not disseminating messages that violate the dignity of others or that are rude or disrespectful.
- Not performing actions against the rights of others in any form.
- Not storing or otherwise collect personal information or data from third parties without their consent, including email addresses.
- Not eluding, avoiding or 'jumping' the measures used to prevent or restrict access to the portal.
- Not causing damage to the UA or third parties’ computer systems, nor introducing or spreading computer or any other type of system viruses that may cause damage to computer systems.
The user acknowledges and accepts that any contractual or extracontractual relationship with advertisers or third parties contacted through the application, as well as their participation in contests, promotions, sale and purchase of goods or services, are understood to be carried out solely and exclusively between the user and the advertiser or third party. The user therefore accepts that the UA has no liability of any kind for damages of any nature caused by reason of their negotiations, conversations, contractual or extra-contractual relations with advertisers, third parties, natural or legal persons contacted through the application.
The user declares that:
- The content that they publish is their exclusive property or they have the rights to use it.
- The content that they publish does not infringe the copyright or intellectual property rights of others.
- The content that they publish does not violate the legislation in force, the honour, privacy or image rights of individuals.
- They shall not publish the text, photos or images of third parties without their previous authorisation.
- The shall not publish ads with erotic, sexual or pornographic content.
- They shall not publish special pricing numbers (starting with 905, 806, etc.).
RESPONSIBILITIES
The content of the ad is the advertiser’s exclusive responsibility.
The UA may review the content and consider whether it is unlawful or against its policies. If it deems it to be so, it may remove it or refuse to publish it. However, this power reserved to the UA does not necessarily imply that it reviews the content.
The UA is not responsible for the content there or the actions performed by other users. Nor is it responsible for any damage or harm resulting from the presence of viruses or other elements in the content and services provided by third parties. Likewise, the UA shall not be liable for damages of any nature following negligent or malicious use of e-mail accounts used to insert an advertisement or respond to an advertisement.
In any event, the UA shall not be liable, either indirectly or subsidiarily, for economic loss or reputation, or for any special, indirect or consequential damages resulting from the user's use of the website.
The disclaimer of liability stated in the preceding paragraph shall apply in the event that the UA does not have actual knowledge that the activity or information stored is illicit or that it damages the property or rights of a third party liable for compensation. In the event that it becomes aware of that activity or information, it will act diligently to remove the data and contents or make access to them impossible.
BREACH OF CONTRACT
In case of breach of these Terms, the UA reserves the right to cancel unilaterally and at our sole discretion and without notice, access, use, or user sign-up for the application, without giving rise in any case to compensation.
Similarly, the UA reserves the right not to publish or delete unilaterally any messages that do not comply with the terms of use, at our sole discretion and without notice.
Information about data protection
In compliance with current legislation on data protection, you are informed that the University of Alicante shall process the data provided in this form, as well as those contained in the documents attached for the purpose of managing the Classified Ads application. This app offers ads sent by companies and individuals for the University of Alicante members (students, administration staff and academic staff) through UACloud tools.
Legitimacy of data processing is based on the consent of the provider of the activity in the Classified Ads application.
Legitimacy of data processing is based on the execution of the contract that links the University of Alicante with each of the companies involved.
Within the framework of the aforementioned processing, your data will not be transferred to third parties unless we are legally obliged to do so.
In this regard, we inform you that you can exercise your rights of access to and rectification or erasure of personal data, among others, by means of request submitted to the University of Alicante Registry Office, or via its e-Services Portal (https://seuelectronica.ua.es/es/index.html)
