OBJECTIVES

• To comply with the training requirements established by Act 34/2006 of 30 October, in relation to court  solicitor.
• To provide quality vocational training of future lawyers and practising lawyers in that the relevant staff from the Administration of Justice will guarantee the exercise of fundamental rights to effective judicial tutelage.
• To facilitate integration of post-graduates in the labour force by providing them with knowledge of the legal framework and present day legal practice context.
• To raise awareness among students as regards the democratic values and the code of conduct and ethics related to this profession.
• To prepare students for the accreditation of their professional training.

Specific Competences (CE)

• CE1:Poseer, comprender y desarrollar habilidades que posibiliten aplicar los conocimientos académicos especializados adquiridos en el grado a la realidad continua y cambiante a la que se enfrentan los procuradores de los tribunales, que les permitan garantizar y asegurar la gestión de los intereses de sus representados antes, durante y después del procedimiento judicial.
• CE2:Conocer y ser capaz de integrar la postulación de los derechos de los representados en el marco de los sistemas de tutela jurisdiccional nacionales e internacionales.
• CE3:Conocer las técnicas procesales y ser capaz de ejecutar cuantos actos les encomienden o para cuya realización estén facultados en los distintos órdenes jurisdiccionales, con especial atención a los plazos, actos de comunicación, ejecución y vías de apremio.
• CE4:Conocer y saber aplicar los derechos y deberes deontológicos profesionales que informan las relaciones del procurador de los tribunales con el cliente, con las otras partes, con el tribunal o autoridad pública y entre los procuradores y demás profesionales.
• CE5:Conocer y evaluar las distintas responsabilidades vinculadas al ejercicio de la actividad profesional, incluyendo el funcionamiento básico de la asistencia jurídica gratuita y la promoción de la responsabilidad social del procurador de los tribunales.
• CE6:Conocer y aplicar las técnicas dirigidas a la identificación y liquidación de derechos arancelarios, obligaciones tributarias, de constitución de depósitos judiciales y de atención de cuantos gastos y costas sean necesarios para garantizar la efectiva tutela judicial de los derechos de sus representados.
• CE7:Saber identificar conflictos de intereses y conocer las técnicas para su resolución, establecer el alcance del secreto profesional y de la confidencialidad, y preservar la independencia de criterio.
• CE8:Disponer de la capacidad de actuar de acuerdo con las exigencias que impone el entorno organizativo, de gestión y comercial de la profesión de procurador de los tribunales, así como su marco jurídico asociativo, fiscal, laboral y de protección de datos de carácter personal.
• CE9:Capacidad para elegir los medios más adecuados que ofrece el ordenamiento jurídico para el desempeño de una representación técnica de calidad.
• CE10:Desarrollar las habilidades y destrezas necesarias para la correcta y eficaz realización de los actos de comunicación a las partes en el proceso, y para una colaboración eficaz con los tribunales en la ejecución de las resoluciones judiciales, conociendo y diferenciando los intereses privados que representa de los de carácter público cuya ejecución la Ley y los tribunales le encomienden.
• CE11:Desarrollar las destrezas y habilidades necesarias para la utilización de los procedimientos, protocolos, sistemas, y aplicaciones judiciales, que requieran los actos de comunicación y cooperación con la Administración de Justicia con especial atención a los de naturaleza electrónica, informática y telemática.
• CE12:Disponer de las habilidades necesarias para auxiliarse de las funciones notarial y registral, en el ejercicio de su representación técnica de calidad.
• CE13:Conocer, saber organizar y planificar los recursos individuales y colectivos disponibles para el ejercicio en sus distintas modalidades organizativas de la profesión de procurador de los tribunales.
• CE14:Saber exponer de forma oral y escrita hechos, y extraer argumentalmente consecuencias jurídicas, en atención al contexto y al destinatario al que vayan dirigidas, de acuerdo en su caso con las modalidades propias de cada ámbito procesal y gubernativo.
• CE15:Desarrollar destrezas que permitan al procurador de los tribunales mejorar la eficiencia de su trabajo y potenciar el funcionamiento global del equipo o institución, bien sea de carácter específico o interdisciplinar.

Skills/Skills

• CB7:Que los estudiantes sepan aplicar los conocimientos adquiridos y su capacidad de resolución de problemas en entornos nuevos o poco conocidos dentro de contextos más amplios (o multidisciplinares) relacionados con su área de estudio.

ENTRY REQUIREMENTS

According to the Regulations of the University of Alicante, the following requirements must be complied to have access to official taught Master’s degrees:

1. To be in possession of a SPANISH OFFICIAL GRADUATE DEGREE CERTIFICATE or other issued by an institution of higher education  within the EHEA (European Higher Education) that enables the holder to have access  to Master’s degrees in the issuing.
2. To be in possession of an officially approved  FOREIGN HIGHER EDUCATION DEGREE CERTIFICATE that had been recognised as equal to the degree that allows access to the requested studies.
3. To be in possession of a UNIVERSITY DEGREE CERTIFICATE obtained in a University or Higher Education Institution of COUNTRIES OUTSIDE THE EHEA, without the prior approval of their studies. In this case, the following should be considered:

• Non- recognised degree certificates shall require a technical report showing an equivalence statement issued by the University of Alicante (ContinUA – Continuing Education Centre), for which the corresponding fee should be paid.
• Access through this way does under no circumstances imply prior official approval of the holder’s degree certificate, nor its recognition for purposes other than studying a master's degree.

ADMISSION AND ASSESMENT CRITERIA

Given that the Master in Law is offered to cover the educational and practical professional requirements established by the regulations which govern access to the legal profession, “Ley de Acceso, the admission requirement is set out in Article 2.1.a) of the Royal Decree 775/2011, dated 3 June,( whereby the Regulation of Act 34/2006, dated October 30 is approved regarding access to the professions of Advocate and Court Solicitor), that is,  “Applicants holding degrees in Law, Law graduates or other equivalent university degrees which meet the requirements of Article 3 of this regulation”.

According to Article 3 of Royal Decree 775/2011 of 3 June, (which approves the Regulation of Act 34/2006, dated 30 October, on access to the professions of Advocate and Court Solicitor) the aforementioned requirements are as follows:

The undergraduate degrees referred to in Article 2, clause a) must accredit the acquisition of the following legal competences:

a)    Knowledge and understanding of the elements, structure, resources, interpretation and application of law, and ability to interpret the sources and fundamental legal concepts of jurisprudence and different law systems.

b)  Knowledge and understanding of the mechanisms and procedures for resolving legal disputes, and the legal position of individuals in their relations with both government and the authorities.

c)  Knowledge of how to apply the criteria of priority of sources to determine the rules applicable in each case, and especially that of compliance with rules, and constitutional principles and values.

d)  Interpretation of legal texts from an interdisciplinary perspective using legal principles and social, ethical and deontological values and principles as  analysis tools

e)   Delivering convincing legal arguments on a theoretical question concerning various legal matters.

f)   Solving case studies according to existing Law, which involves the prior preparation of material, identification of problematic areas, the selection and interpretation of the existing law applicable and a reasoned exposition of the subsumption.

g)   Management of  legal language and terminology of different branches of the law with skill and precision to include the drafting of legal documents in an orderly and understandable manner as well as the oral and written communication of ideas, arguments and legal reasoning using the appropriate register in each context.

h)  Using information and communication technologies for search and legal information (from legislation databases, jurisprudence, bibliographies, etc.) and as a tool for work and communication.

No additional requirements are established. However, if the number of applications exceeds the number of available places, admission will be ¿¿according to the average mark of the Law degree. In this case, the Committee for the Coordination of the Master’s Degree may priories admission of  applicants who are required to study the Master’s Degree over those who are or may already be chartered legal professionals and do not need the professional qualification of court solicitor under the existing regulations which govern access to the legal profession.

Students who wish to study for an Official Master’s Degree at the UA should complete pre-enrolment in accordance with the deadlines and conditions specified annually.

Following publication of the definitive list of those admitted to the course, applicants will receive an email containing a password which will serve as a User ID, enabling them to enrol via the Campus Virtual in accordance with the deadlines and conditions established annually.

In the registration process, the documents issued abroad must be official, duly notorised and translated. Further information:
